Social Security Disability FAQ

Answers to Common Social Security Disability Questions
Emmanuel, Sheppard & Condon Personal Injury Attorneys

Many of our clients have several questions regarding Social Security Disability (SSD) and Medicare after a serious accident. Below are some of the most common questions we receive and a brief answer. Please contact us for additional information.

How do I apply for Social Security Disability benefits?

According to the Social Security Administration, to apply for disability benefits you will need to complete an application for Social Security Benefits and an Adult Disability Report. We can help you get the necessary forms and correctly complete them.

Does my injury or my medical conditions entitle me to disability benefits?

Your injuries or medical conditions, alone may not necessarily entitle you to receive disability benefits. In order to qualify, you must meet specific guidelines outlined by the Social Security Administration and complete an application. Most SSD claims are denied the first time. If your social security disability claim was denied, our SSDI lawyers can help you file an appeal.

Can I file for Social Security if I haven't worked for years?

In most instances, you must have worked five out of the last ten years to qualify for SSD. If you have not worked for several years, you may not qualify to receive disability benefits. Contact us to help you figure out whether or not you are eligible to receive SSD benefits.

How long must I wait before I can file for Social Security Disability benefits?

In order to qualify for disability benefits, your injuries must be so severe that you are unable to work because of a medical condition that is expected to last at least one year, or that is leading to your eventual death. Although there is no set time to wait before you apply, you may want to ensure your injuries are severe enough to qualify for benefits. In addition, there are certain things you can do before you apply to help speed up the process. Please contact an attorney for more information.

If my disability is not permanent, do I qualify for Social Security benefits?

Maybe. You can only collect SSD benefits if you have a disability that is expected to last twelve months or longer.

If you have questions about SSD benefits, please contact our office in Pensacola, Florida. We will answer your questions and help you in any way we can. You can find more answers to your social security disability questions at the Social Security Administration website.
